Terms of Service

1. Agreement to Terms

By accessing or using PostPal's website and services at postpal.ca (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

PostPal reserves the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

2. Description of Service

PostPal provides an online platform that allows users to compose, customize, and send physical letters and mail. We print your letters, place them in envelopes, apply postage, and mail them through Canada Post or other postal carriers on your behalf.

3. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and complete information for all mail orders
  • Not use the Service for any unlawful purpose or to send prohibited content
  • Not send mail that is harassing, threatening, defamatory, obscene, or otherwise illegal
  • Not impersonate any person or entity
  • Comply with all applicable laws and regulations

4. Prohibited Content

You may not use the Service to send mail containing:

  • Content that violates any law or regulation
  • Harassment, threats, or intimidation
  • Defamatory or libelous statements
  • Fraudulent or deceptive content
  • Content that infringes on intellectual property rights
  • Obscene or pornographic material
  • Unsolicited commercial mail (spam)

PostPal reserves the right to refuse to process any order that violates these Terms.

5. Payment and Refunds

All payments are processed securely through Stripe. Prices are listed in Canadian dollars (CAD) unless otherwise specified.

Refunds may be issued at PostPal's discretion for orders that have not yet been printed and mailed. Once a letter has been mailed, refunds are generally not available as the postal service cannot retrieve mail in transit.

6. Delivery

PostPal mails letters within 24 hours of order processing (excluding weekends and holidays). Delivery times depend on the postal service and destination:

  • Domestic (Canada): Typically 2-5 business days
  • International: Varies by destination, typically 6-15 business days

PostPal is not responsible for delays caused by the postal service, incorrect addresses provided by users, or other factors beyond our control.

7. Letter Templates Disclaimer

PostPal provides letter templates, including legal templates, for convenience and general informational purposes only.

LEGAL TEMPLATES ARE NOT LEGAL ADVICE. These templates are provided "as is" and do not constitute legal advice, create an attorney-client relationship, or guarantee any particular legal outcome.

You acknowledge and agree that:

  • You are solely responsible for the content of any letter you send using our Service
  • You should seek professional legal advice for matters with legal implications
  • Templates may not be appropriate for your specific situation or jurisdiction
  • PostPal makes no representations about the legal sufficiency, validity, or enforceability of any template
  • PostPal is not liable for any consequences resulting from your use of these templates

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. POSTPAL MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

POSTPAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Personal injury or property damage
  • Any damages arising from the content of letters sent through the Service
  • Any legal consequences resulting from letters sent, including those using our templates
  • Delivery delays or failures by postal carriers
  • Errors in addresses or content provided by users

IN NO EVENT SHALL POSTPAL'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless PostPal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

10. Intellectual Property

The Service, including its content, features, and functionality, is owned by PostPal and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our express written permission.

11. Termination

PostPal may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
